By accessing our website and placing an order, you agree to be bound by the following Terms and Conditions. Please review them carefully before using our services.

1. Use of Our Website

By using this website, you represent that you are at least 18 years old and legally capable of entering into a binding agreement. You agree not to use this website for any unlawful purpose or in violation of these Terms.

2. Products and Services

Messenger Print & Mail provides custom printing, mailing, and related marketing services. All products are produced based on customer-submitted specifications.

We reserve the right to refuse or cancel any order that violates applicable laws or regulations, contains unlawful, offensive, or misleading material, infringes on intellectual property rights, or conflicts with company policies or values.

3. Orders, Files, and Proof Approval

Customers are responsible for ensuring that all submitted materials, including artwork, mailing lists, and order details, are accurate and complete.

When applicable, digital proofs will be provided for review and approval prior to production. Production will not begin until proof approval is received. Once approved, Messenger Print & Mail is not responsible for errors including, but not limited to spelling or grammar errors, color variations, layout or formatting issues, incorrect quantities, and address or mailing list inaccuracies.

4. Pricing and Payments

All prices are listed in U.S. dollars unless otherwise stated. Full payment is required prior to production unless otherwise agreed in writing. We reserve the right to modify pricing, fees, and service offerings at any time.

5. Production and Delivery Timeframes

Production and delivery timelines are estimates and are not guaranteed. Delays may occur due to customer approval delays, file revisions, equipment issues, and shipping or postal delays.

Messenger Print & Mail is not responsible for delays beyond our reasonable control.

6. Mailing Services and Postal Responsibility

For mailing services, Messenger Print & Mail acts as a service provider and facilitator. We are not responsible for USPS or carrier delays, undeliverable mail caused by incorrect or outdated addresses, postal service errors or losses, or changes in postal regulations or rates.

Mail quantities may vary slightly due to industry-standard processing tolerances.

7. Mailing Lists and Data Handling

Customers are responsible for ensuring they have the legal right to use all mailing lists submitted. This includes compliance with applicable laws, including CAN-SPAM and applicable privacy regulations.

Messenger Print & Mail treats customer mailing lists and data as confidential and uses them solely for order fulfillment unless otherwise authorized. We implement reasonable safeguards to protect customer data but cannot guarantee absolute security.

Mailing lists may be stored temporarily for order processing and reorders. Customers may request deletion in writing.

8. Returns, Refunds, and Reprints

Because our products are custom-made, all sales are generally final. Refunds or reprints may be issued on a case-by-case basis, primarily when an issue is determined to be the result of an error by Messenger Print & Mail.

To be eligible for review: 

-Issues must be reported within 21 days of delivery

-Supporting documentation must be provided when requested

-Affected materials may need to be returned or verified

Errors resulting from customer-approved proofs or submitted files are not eligible for refunds or reprints.

All refund and reprint decisions are made at our sole discretion.

9. Intellectual Property Rights

Customers represent that they own or have authorization to use all submitted content, including text, images, and logos.

Customers agree to indemnify Messenger Print & Mail against any claims arising from copyright, trademark, or intellectual property violations.

We reserve the right to display completed projects for portfolio and marketing purposes unless otherwise requested in writing.

10. Limitation of Liability

Messenger Print & Mail’s total liability for any claim shall not exceed the amount paid for the affected order.

We are not liable for indirect, incidental, special, or consequential damages, including lost profits, lost marketing opportunities, or business interruption.

11. Indemnification

You agree to indemnify and hold harmless Messenger Print & Mail and its owners, employees, and partners from any claims, damages, or expenses arising from submitted materials, mailing list usage, violation of these Terms, misuse of services.

12. Account Responsibility (If Applicable)

If an account is created, you are responsible for maintaining the confidentiality of login credentials and all activity under your account.

We reserve the right to suspend or terminate accounts for violations of these Terms.

13. Right to Refuse or Terminate Service

Messenger Print & Mail reserves the right to refuse service, cancel orders, or terminate access at any time for violations of these Terms or applicable laws.

14. Governing Law and Venue

These Terms shall be governed by and interpreted under the laws of the State of Texas.

Any legal action or proceeding shall be brought exclusively in the courts located in the State of Texas.

15. Changes to Terms

We reserve the right to modify these Terms at any time.

Continued use of our website or services after changes constitutes acceptance of the updated Terms.
